New bill seeks to force employers to publicly report sexual harassment settlements
New bill seeks to force employers to publicly report sexual harassment settlementsNew bill seeks to force employers to publicly report sexual harassment settlementsIn recent months, multiple employees across industries have come forward with their stories of workplace sexual harassment as part of the MeToo movement. In many cases, these stories were silenced through settlements or restrictive non-disclosure agreements. Hollywood producer Harvey Weinstein, for example, reached at least eight settlements with women after they confronted him about his unwanted sexual advances for decades, according toThe New York Times. Now theres a new bill that wants to track which companies are using money to try and keep stories of sexual harassment from going public.Companies would need to disclose sexual harassment dataCalled the Sunlight in Workplace Harassment Act, the bill co-sponsored by Senator Elizabeth Warren andNevada Representative Jacky Rosenseeks to force companies to publicly report sex ual harassment data. If the bill became law, companies would be required to report both the total number and the total dollar amount of settlements they had made related to sexual harassment. In addition, companies would need to report the average length of time it took to resolve a sexual harassment complaint. The bills language is broad, seeking to protect both contractors and full-time employees in and out of the office companies would need to report settlements that involve the behavior of an employee of the covered issuer, or a subsidiary, contractor, or subcontractor of the covered issuer, toward another such employee, without regard to whether that behavior occurred in the workplace. As MeToo has reminded us, sexual harassment occurs in all workplaces - from factory floors to corporate boardrooms. Our bill will help systemically expose workplace harassment and push employers across the country to aggressively prevent it,Sen. Warren said in a statement. Im working to make sure Congress prevents workplace harassment both within its walls and outside of them. While companies would get exposed, victims would still be allowed to remain anonymous. The bill would not force companies to include the names of victims in sexual harassment settlements. The bill follows other legislation sparked by the silence around sexual harassment in the workplace. Following the Weinstein scandal, legislators in New York proposed banning confidentiality agreementsthat conceal sexual harassment, calling for them to be made unconscionable, void and unenforceable.

The 2 sneaky reasons great employees become unmotivated
The 2 sneaky reasons great employees become unmotivated The 2 sneaky reasons great employees become unmotivated Most employees begin a new job brimming with enthusiasm and excited to bring a fresh perspective to the organization. As time passes though, that enthusiasm can turn into boredom or even full-on disengagement when circumstances change or they start to see things in a different light. This isnât only relevant for individual contributors and junior-level roles either â" even more senior-level employees and C-suite executives can become unmotivated, in companies of all sizes and industries.Research shows that the majority (50.8%) of employees is the U.S. are ânot engagedâ while another 17.2% say that they are âactively disengaged.âWhat this all really means is that a good portion of your best employees might feel unmotivated to some degree as well, at this very moment. To be fair though, there are some reasons an employee might lose motivation that you have limited control over, such as poor role fit, poor culture fit, personal or health issues, or interpersonal issues with c olleagues and / or managers. But aside from those reasons, there are two other distinct reasons great employees become unmotivated that every company leader should be aware of:1. Lack of ChallengePsychologists define motivation as an internal process that makes a person move toward a goal. Itâs literally the desire to get things done. So, when you want to make sure your employees donât become unmotivated, remember that they need:1) an understanding of the tasks they are supposed to do, and 2) some goals to work towardThe first point, understanding tasks, is easier to take care of. Managers should fully clarify and reinforce each employeeâs responsibilities and also ensure that the balance and / or load of work across the team is reasonable. The second point can be thornier to deal with. Establishing a goal is critical to feeling motivated to perform. At the same time, any old goal just wonât do. Goals should excite and inspire your employees to feel a sense of challenge. One of the best ways to get employees on board is to solicit their opinions on new initiatives or projects. Feeling like they have a say in the decision-making process makes employees feel much more invested in the outcome.Another great way to increase the feeling of being challenged is to gamify your workplace. Gamification involves the creation of an incentive structure to encourage your employees to achieve. About 72% of employees say that gamification makes them work harder. The great thing ab out gamification is that it can be applied to nearly any aspect of your business and it doesnât have to be complicated or complex. For example, Lawley Insurance ran a two-week contest to improve its sales pipelines, rewarding employees for updating close dates, logging prospect contact attempts, and entering new opportunities. In 2 weeks, employees logged more Salesforce activity than in the prior 7 months combined.2. Disconnect between the Companyâs Beliefs and ActionsThe other major reason employees become unmotivated is that they either no longer believe in the companyâs mission, or find that there is a disconnect between what the company says it values, and the actions they take that demonstrate the contrary. For example, perhaps your organizationâs core values include striving for excellence and employee recognition, but as of late the company has gotten out of the habit of rewarding excellence and rather into the habit of ignoring mediocre performance. For high-perfor ming employees, it can be very frustrating to watch colleagues face no consequences when theyâre not âpulling their weight.â Pretty soon, your best employees might start thinking, âIf Bob can get away with playing around on his phone and submitting sloppy reports, why should I bother?â To counteract this, managers should get in the habit of providing personalized feedback to recognize excellence and always being mindful of the company values that likely attracted your top performers. When managers act with integrity and recognize employeesâ contributions, engagement rises 60%.In addition to paying attention to in-house disconnects between belief and action, it is also essential to maintain a consistent external employer brand. If your company professes transparency but practices secrecy, employees will begin to feel less motivated to achieve. Similarly, bad business practices or public scandals undermine morale and discourage prospective talent from considering your com pany. Take a hard look at your mission and core company values and ask for employee feedback about how you can better behave in line with your professed values.Lack of motivation at work can have reverberating consequences, Employees with low morale can complain and suck the motivation from everyone else. Fortunately, taking steps to increase challenges at work and ensure that your company is aligning its actions with its professed beliefs can transform your workplace culture. This article was originally published on Kununu.com.

How to Crush Your First Month on the Job
How to Crush Your First Month on the Job How to Crush Your First Month on the Job Calling all new college grads taking on their first job ever , and everyone whoâs ever hopped from company to company to take on a new, cooler position: You know that first month is clutch. You can crush it and set yourself up for success at the company, or fall (proverbially) flat on your face, left worrying whether you have a future here. As career coach Hallie Crawford explains, âduring the first month of any job, you are being observed carefully- especially as a new grad with little work experience.â Why? âManagement will want to make sure they have made a good investment and that you are living up to what you said you could do in your interview,â she says. Donât worry, though: Weâve got eight expert-approved ways for you to stand out in all the right ways during your first month on the job . Here they are: 1. Be diligent. Mistakes happen, of course, but you wonât knock your bossâ socks off by making too many in your first month. Luckily, most mistakes are easy to avoid, says Crawford, if you are simply diligent and double-check your work. And sure, âyou donât want to be a show-off,â Crawford says, âbecause that could be annoying to your new co-workers, especially if you are a recent grad. But by being diligent with your tasks and assignments, you show the office that you are a solid worker.â 2. Be the early bird and night owl. This advice wonât help you find that perfect work-life balance we know you crave, but like it or not, putting in more time than anyone else in the office- at least in that first month- will make you stand out. As millennial career expert Jill Jacinto explains, âputting in face time at the office is important in these first few weeks.â She advises that you show up before your boss arrives, and clock out after he or she has left for the day. âPut in the extra hours to work on a new deadline or take an early call with a client who is overseas,â she says. 3. Use your strengths. You got this job because you showed off some serious skills . So now that youâre at your new desk, donât hide them away. âIn your interview, you most likely listed the strengths you would use at your new position,â says Crawford. âMake sure that you are finding ways to put that into practice daily.â When you do, your boss will feel like he or she made the right decision in hiring you, according to Crawford. Bonus: âIt will help you feel fulfilled in your new position,â too,â she says. 4. Make like a cat and be curious. While you shouldnât watch cat videos on the job, mimicking those creatures- in one way, at least- could pay off big time. Hereâs how be curious, the right way: âGet to know the inner workings of the company by asking questions and doing research,â Jacinto says. Plus, âthe more background you have, the better informed youâll be to handle an issue or refer back to a product or client.â 5. Be friendly, and make friends. âThis seems like a simple tip, but donât forget to get to know your new coworkers and do your best to get along with them,â advises Crawford. âManagement will want to make sure that you fit into the office culture.â But how do you get to know people- like, really know them? âBe observant,â says Crawford. âHow do your coworkers interact with each other? Is a little conversation between cubicles or offices acceptable? Do they go on break together?â With all this inside information, you can take the initiative with you new coworkers. âStrike up friendly conversation with them, but donât be too pushy,â Crawford suggests. 6. Ask for feedback. We get it: Asking your boss how youâre doing can be a scary thought. After all, no one likes to hear criticism. But push past that fear and, âafter your first week, ask to schedule a short meeting with your manager or team leader to see if there is anything you can improve on,â says Crawford. Hereâs why: When youâre open to feedback, you show your boss that you want to succeed, and that you arenât afraid to do what it takes to get there. âJust keep in mind that if they do offer a few suggestions, look for ways to put them into practice immediately,â she says. 7. Put your phone away. Stick it in your purse or hide it away in your top drawer, and set it to silent. Otherwise, you might be tempted to look at your smartphoneâs small screen more often than you check your work email. âIâve seen countless new hires spend half their day on the phone and it immediately provided me a negative impression of them,â says Jacinto. âStay focused on your job and not your Snapchat story - unless that is indeed part of your job.â 8. Avoid making comparisons. Change can be tough, whether youâre taking on a new job as a college grad or youâre moving over from another company. But, âif you are a recent grad and this is your first job , avoid making comparisons with working and studying while on the job,â advises Crawford. Instead, vent to friends and family after work hours. On the flip side, âif you worked at a previous company beforehand, avoid comparing your new job with your old job, and instead, do your best to accept new ways of doing things,â says Crawford.

Avoiding Media Bias When Covering Political News
Avoiding Media Bias When Covering Political News Avoiding Media Bias When Covering Political News Politicians and their staff members are usually experts at manipulating media coverage in order to advance their careers and their campaigns. That includes accusing reporters of media bias when unfavorable stories are published in print, on the air or online. When covering political news stories, make sure your stories measure up to ethical standards so your reports dont back up their claims of media bias. Expect to Be Accused of Media Bias Any reporting on a political campaign will include good and bad news. If you are assigned to cover a candidate, there will be a day she stumbles making a verbal gaffe, misstating a fact or sometimes literally stumbling as she trips over a broken sidewalk. Reporting facts doesnt equal media bias, though overly-aggressive campaign workers might try to con voters into thinking that. Check Your Stories for Accuracy Some reporters who dont have media bias are guilty of lazy reporting, which can appear to be the result of political leanings. Make sure all political stories are accurate because campaign workers will be happy to rip your reports to shreds if it benefits their candidate. Any reporter knows whether his story will please or perturb a campaign. If you suspect that there will be fallout to a story thats about to be published, comb over the facts for accuracy to protect yourself and your media company. Decide if you are completely confident in the information you are presenting. If your source is a news release from an opponents campaign, verify the facts independently or at least make it clear that its the opponent who is making an accusation, not you. Sloppy attribution can get you into trouble. Even in the casual world of the Internet, your online attribution must be clear, and that includes posts on Twitter or Facebook. Determine Whether Your Story is Fair to All Candidates A political story can be completely accurate, yet not be totally fair to the candidates. Thats another easy way for charges of media bias to be made against you. If you report that one wealthy candidate paid very little income taxes thanks to the creative use of loopholes, you owe it to your audience to investigate the other candidates tax returns. If that information isnt being made available to you, you should report that. Fairness involves more than thorough fact-finding, it also includes careful attention to the wording of your stories. Creative writing techniques that work in other forms of reporting are dangerous in political stories. Using the income tax example, saying the candidate paid a paltry or tiny amount of taxes is letting your personal judgment affect your writing. If a tax expert says the candidate should have paid ten times the amount in taxes, say that and attribute it to the expert. Boasting that you uncovered this tax information implies that the candidate was trying to hide it. If all you did was read her news release, you didnt uncover anything. Defend Yourself Against Claims of Media Bias A good way to prepare to defend yourself against claims of media bias is to practice making those charges yourself. Learn how to scour stories to pick up on terms and ideas that could indicate a point of view. If a campaign manager complains about how a story thats unfavorable to the campaign is an example of media bias, point out the more positive stories you have produced. You dont owe him an apology, just a reminder that your reporting is balanced. Never promise youll give him a glowing story tomorrow. Voters, who are accustomed to claims of media bias, are often harder to convince if they worship the candidate they believe you unfairly slaughtered. Ask them why they believe the story is unfair and gently defend yourself. Theres no benefit to getting into an argument that you cant win. Political campaigns are a roller-coaster ride. When a campaign is down, fingers often point at news coverage. By asking your own tough questions of your reporting skills, you will protect your reputation against unfounded charges of media bias.

Loan Agreement FAQ - Australia
Loan Agreement FAQ - Australia Loan Agreement FAQ - Australia DefinitionsWho is the Borrower? The Borrower is the person or corporation that receives value (money, property or some service) from the Lender on the condition that the Borrower will pay the principal amount plus any interest to the Lender at sometime in the future. Who is the Lender? The Lender is the person or corporation that gives something of value (money, property or some service) to the Borrower on condition that the Lender will be paid a certain amount in the future. What is the governing law for a Loan Agreement? The governing law is the law of the jurisdiction in which the Loan Agreement will be entered into. Often the parties select the jurisdiction where the Lender resides. If the Loan Agreement relates to the purchase of certain assets, then the location of those assets is selected. What is the Principal amount? The principal is the original amount of the loan that is owed by the Borrower to the Lender on the date the Loan Agreement is signed. Once the Borrower has begun to pay back the loan, the principal refers to the amount of money still owing to the Lender at any given moment in time. What is interest?Interest is an amount charged to a Borrower for the use of the Lender's money. It is usually expressed as a percentage of the amount borrowed and is calculated at a specified interval over the course of the term of the Loan Agreement. The interest rate is the annual interest rate. What does compounded mean?Compounded refers to how frequently the interest is calculated and added to the principal amount of the loan to arrive at a new balance. The more frequently the interest is calculated, the more interest the Borrower will end up paying to the Lender. What is a demand loan agreement? The balance owing in a loan agreement does not need to be repaid until the Lender demands to be repaid. In other words, the loan is repayable 'on demand'. There is no fixed end date for the repayment of the loan. Upon demand, the Borrower is given a certain period of time to repay the outstanding balance of the loan agreement. What is the Term? The Term is the time length of the loan agreement. At the end of the term, the Borrower must repay the outstanding balance of the loan. Loan Agreement DetailsI am a shareholder. Should I use the Loan Agreement or the Shareholder Loan Agreement? As a shareholder, if you are lending money to the corporation, use our Shareholder Loan Agreement. If you are borrowing money from the corporation, use our Loan Agreement. Use our promissory note if you prefer a more basic and simpler document than the Loan Agreement. Do I have to charge the Borrower interest? No, the Lender can choose whether or not to charge interest. If the Lender decides to charge interest, they can pick how much interest to charge. However, there may be tax consequences to the Lender or Borrower if interest is charged but it is not a reasonable rate. What are the payment options available? There are four options for the method of repayment. Specific periodic amounts - the Borrower will make a certain payment to the Lender on regular intervals. Lump sum payment at the end of the term - the Borrower pays nothing to the Lender until the end of the note term, at which time the Borrower repays the entire note in one payment. Interest only - the Borrower makes regular payments to the Lender that are put toward paying off the interest on the principal amount only, with no portion of the payment going towards the principal amount itself. Interest and principal - the Borrower makes regular payments to the Lender that are put toward paying off both the principal amount and the interest as it is compounded. At the end of the term of the Loan Agreement, there will be no outstanding balance to be repaid. Should the Lender require the Borrower to provide security/collateral for the note?If you do not take collateral, and the Borrower defaults on the loan, you will have to take the Borrower to court in order to recover your money and your judgment can only be enforced against certain assets of the Borrower. However, if you take collateral for the loan agreement, then you may be entitled to seize and sell the collateral if the Borrower fails to repay the loan. Does the collateral need to be equivalent in value to the amount of the loan? No, if collateral is given for the loan, it can be for any amount. If the Borrower fails to repay the note, and the collateral is worth less than the note, then the Lender can seize the collateral and sue the Borrower for the remaining amount of the loan. If the Lender recovers more than the outstanding balance from the sale of the collateral, any surplus amount would be returned to the Borrower or his other debtors depending upon the situation. National Consumer Credit Protection Act and Required DisclosuresWhat is the National Consumer Credit Protection ActThe National Consumer Credit Protection Act (the 'Act') is a set of laws developed to standardise credit practice in Australia. If you pay a business for credit and use the credit (loan) mainly for personal, household or domestic purposes, then the National Consumer Credit Protection Act will affect you. Does the Act apply to my loan agreement? The Act will apply to your loan agreement if: the borrower is a natural person ordinarily resident in Australia or a strata corporation formed in Australia; and the credit is provided or intended to be provided wholly or predominantly for personal, domestic or household purposes; and a charge is or may be made for providing the credit; and the credit provider provides the credit in the normal course of business or incidentally to any other business of the credit provider. Are there any disclosures that the lender must provide to the borrower before entering into a loan agreement? If the Act applies to your agreement, the lender cannot enter into a loan agreement unless the lender has given the borrower the following: a precontractual statement setting out the matters required by section 17 of Schedule 1 to the Act; and an information statement in the form required by the regulations stating the borrowers statutory rights and statutory obligations. These statements must be given before the contract is entered into or before the debtor makes an offer to enter into the contract, whichever occurs first. Where can I access the requirements for the precontractual statement?Requirements for your precontractual statement are set out in s.17 of Schedule 1 to the Act (the National Credit Code). You can access the code at: austlii.edu.au/au/legis/cth/consol_act/nccpa2009377/sch1.html Remember: The precontractual statement may be the proposed loan agreement itself or may be a separate document or documents. Where can I access the information statement? You can access the information statement in the regulations at: (Form 5) comlaw.gov.au/Details/F2012C00052 Other considerations from the Act: Sale of land or purchase of goods by installmentIf the credit (loan) is provided by the supplier for a sale of land or for the sale of goods by installment then the Loan Agreement must contain a description of the land and its cash price or a description of the goods and their cash price. Loan agreements and seller/vendor financingHow does Seller Financing work?Seller Financing is a loan from a seller to a purchaser where the purchaser does not have the cash to cover some or all of the purchase price of the asset. With Seller Financing, the asset title is transferred to the purchaser who then takes a loan from the seller and grants the seller a security interest in the purchased asset. In the case of a motor vehicle, transferring title of the asset to the purchaser allows the purchaser to acquire insurance and registration. The sole purpose of the loan is to facilitate the purchase of that particular asset. The asset itself is used by the purchaser as collateral for the loan. This means that the Seller could make a claim against the asset if the purchaser should default on one or more loan payments. Also, with Seller Financing, the purchase and sale agreement should contain as much detail as possible regarding the financing particulars including the amount to be fina nced, the term, the rate of interest and frequency of compounding, the monthly payments, the amortization period as well as any penalties for non-payment. Signing DetailsI do not know when the Loan Agreement will be signed. Can I fill in the date later?Yes, by selecting 'Unsure' as the date the agreement will be signed, a blank line will be inserted into the contract so that you can add the correct date after printing the document. Do I need witnesses to sign the Loan Agreement?Generally speaking, there is no requirement for a witness or notary public to witness the signing of the Loan Agreement. However, depending on the nature of the loan and the governing law of the jurisdiction in which you're entering into the loan, you may be required to have witnesses or a notary public witness the Loan Agreement. Even if it is not required, having an objective third party witness the signing of the loan agreement will be better evidence when you need to enforce the repayment of the loan. Signing the note in front of a notary public is the best evidence that the Borrower signed the loan agreement.
